§1 Scope of application
1) The following General Terms and Conditions (GTC) apply exclusively to the business relationship between ANGELA MIKLAS and the purchaser of goods via the online sales platform at www.angelamiklas.com (ANGELA MIKLAS Online Shop).
2) Goods in the sense of these GTC are all products and services that can be purchased in the context of an online order in the ANGELA MIKLAS Online-Shop.
The following General Terms and Conditions do not apply to orders placed with ANGELA MIKLAS outside of the ANGELA MIKLAS Online Shop.
§2 Conclusion of the contract
1) The presentation of goods in the ANGELA MIKLAS Online-Shop does not represent a binding offer for the conclusion of a sales contract.
2. only persons of full age, who have a residential address in Germany, can order. The delivery of goods takes place only in household-usual quantities.
With your order - by clicking the button "Pay now" you make a binding offer to purchase the items in the shopping cart. We will confirm the receipt of your order immediately by email after sending the order.
This automatic confirmation of receipt only confirms that your order has been received by ANGELA MIKLAS and does not represent an acceptance of your request.
4. ANGELA MIKLAS reserves the right to refuse the acceptance of orders.
5. the contract with ANGELA MIKLAS is not concluded until ANGELA MIKLAS confirms the shipment of the goods to you by a separate e-mail.
6. if a delivery of the goods ordered by you is not possible, for example because the corresponding goods are not in stock, ANGELA MIKLAS refrains from a declaration of acceptance. A contract does not come off in this case. We will inform you immediately about this and refund an already received consideration immediately.
7. the conclusion of the contract takes place exclusively in German language.
8. your order data will be stored by us in accordance with the statutory provisions. If you have registered in the ANGELA MIKLAS Online-Shop, you can access your order data under "My Account".
If you lose your order records, please contact us by mail/phone at info@angelamiklas.com or +49 176 83 23 87 01. We will gladly send you a copy of the stored data of your order.
§3 Right of withdrawal and cost sharing agreement
If you are a consumer, you are entitled to the following right of revocation for a purchase in the ANGELA MIKLAS online store:

Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods. However, the period does not begin until the purchase contract has become binding on you through your approval of the purchased item.
Model withdrawal form
1. in order to exercise your right of withdrawal, you must inform us (ANGELA MIKLAS) by means of a clear declaration (e.g. a letter or e-mail sent by post) of your decision to withdraw from this contract. To comply with the withdrawal period, it is sufficient that you send the notice of exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to ANGELA MIKLAS, Mathildenstr. 35, 60599 Frankfurt am Main, Germany, without undue delay and in any case no later than fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.
We shall bear the costs of returning the goods.
You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods.

2. the right of revocation does not exist after §312g Abs. 2 BGB with remote sales contracts for the supply of goods, which are not prefabricated and for whose production a selection or a determination by the consumer is relevant or which are cut clearly on the personal needs of the consumer.
§4 Retention of title
The goods remain the property of ANGELA MIKLAS until they have been paid for in full.
§5 Delivery
1. orders and deliveries are possible in principle only within the EU. If you should wish a delivery into the EU foreign country, then you send us gladly an inquiry to info@angelamiklas.com. Basically the delivery within Germany is done by DHL.
The delivery time within Germany is up to five working days from receipt of order, unless other delivery times are agreed and on the article information page or in the ordering process no other delivery times are specified.
§6 Prices, shipping costs
1. the prices listed in the offer at the time of the order are valid.
2. validity of the prices: The prices stated in the ANGELA MIKLAS online store are Euro prices and end consumer prices, i.e. they include the applicable German statutory value added tax.
Shipping within Germany is free of charge. For orders from abroad, please contact info@angelamiklas.com .
§7 Terms of payment, means of payment
1. basically we offer credit card and PayPal for the payment methods. When paying by credit card, your credit card will be charged at the moment the goods are shipped. When paying with PayPal, your PayPal account will be debited at the moment of the shipment of the goods.
Unless otherwise agreed, payment of the purchase price is due immediately upon conclusion of the contract. We reserve the right to charge a flat reminder fee of EUR 5.00 per reminder as default damages if you are in default of payment. You are allowed to prove that a considerably lower damage than the lump sum or no damage at all has been caused.
3. you agree that you will receive invoices and credit notes exclusively in electronic form.
§8 Warranty
1. the legal liability for defects applies.
2. you can view these terms and conditions on www.angelamiklas.com. In addition, you can print or save this document by using the usual function of your internet service program. You can also download and archive this document in PDF format by clicking here and have provided the necessary programs.
§9 Return of goods
For reasons of simplification, ANGELA MIKLAS asks you to return goods to the address listed on the return form and using the return papers enclosed with each delivery. The acceptance of returned goods does not imply any acknowledgement of your complaints. A corresponding examination takes place only in the logistics of the ANGELA MIKLAS online store.
We point out that in case of deterioration of the goods you may be obliged to pay compensation. Please note in this respect also the revocation instruction under § 3. You can avoid a possible obligation to pay compensation by refraining from everything that impairs the value of the goods and by not using the goods as if they were your property. In addition, you should only try on or inspect the goods as you would have been able to do in a retail store. 3.
Please note that product packaging, such as protective bags for bags and high-quality packaging boxes, is part of the ordered goods. If this product packaging is not returned with the goods, this may result in a significant deterioration of the goods. ANGELA MIKLAS therefore reserves the right in these cases to demand the return of the product packaging or to claim compensation for lost value.
4. a restriction of your right of revocation in accordance with § 3 is not connected with preceding regulations in Abs. 1 - 3.
§10 Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find under the link to the platform of the European Commission. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.

Content and structure of the ANGELA MIKLAS online store are protected by copyright. All texts, pictures, graphics, sound, video and animation files are subject to copyright, trademark law and other laws for the protection of intellectual property of ANGELA MIKLAS or its partners. Copying or other use for other than private purposes or for transmission, other publication, reproduction and distribution, whether in original or modified form and in any medium, or such use on other websites is not permitted without the prior express written consent of ANGELA MIKLAS.
